Privacy Policy

This Privacy Policy explains how DevWharf LLC (“DevWharf”, “we”, “us”, or “our”) collects, uses, and protects information in connection with the devwharf.com website and the DevWharf software applications (together, the “Services”). Data practices differ between the website and the applications, and each is described below.

1. Who we are

DevWharf LLC is a single-member limited liability company organized in the State of Washington, United States, operating as a software consultancy based in Spokane, Washington. DevWharf LLC is the data controller responsible for the personal information described in this policy. We have not appointed a Data Protection Officer. 2. Scope: website and applications

This policy covers two distinct surfaces. The website (devwharf.com) is our marketing site and includes a contact form, a blog with comments, and free browser-based utility tools. The applications are the desktop and mobile software products we publish, including those distributed through the Apple App Store. The applications are designed to operate on your device and do not collect personal data; the data practices below labeled “website” apply only to devwharf.com. Where an application’s behavior differs, the App Store privacy label for that application is the per-app summary, and this policy is the full description.

3. Information we collect

Information you provide (website)

  • Contact form. When you submit our contact form we collect the information you enter: your name, email address, and message (required), and, optionally, your phone number, company, project type, budget, timeline, technology stack, and any files you choose to attach.
  • Blog comments. If you leave a comment on our blog, we collect your name, email address, optional website URL, and your comment. WordPress also records the IP address and browser user agent associated with the comment, and may set a cookie to remember your details if you choose.
  • Email and other correspondence. If you email us, we receive the contents of your message and your email address.

Information collected automatically (website)

  • Technical and usage data. Like most websites, our hosting infrastructure logs standard request data such as IP address, browser type and version, operating system, referring page, and timestamps. When you submit the contact form, the resulting notification email includes the submitting IP address and a timestamp, used to prevent spam and abuse.
  • Cookies and analytics. See the Cookies and analytics section below.

Information from third parties

  • Store purchases. If you buy a product through our storefront (Gumroad) or through the Apple App Store, that processor handles your purchase and shares with us limited order information (such as your name, email, and the product purchased). We do not receive your full payment-card details.

4. How we use information

We use the information described above to:

  • respond to your inquiries, provide quotes, and communicate with you about a project (basis: your consent and steps taken at your request to enter into a contract);
  • operate, maintain, and improve the website and our applications (basis: our legitimate interests in running and improving the Services);
  • fulfill and support purchases made through our store or the App Store (basis: performance of a contract);
  • protect the Services against spam, fraud, and abuse, and maintain security (basis: our legitimate interests and legal obligations);
  • comply with applicable law and enforce our terms (basis: legal obligation and legitimate interests).

We do not use your personal information for automated decision-making that produces legal or similarly significant effects, and we do not sell your personal information.

5. Cookies and analytics

Our website uses Google Analytics, provided by Google, through the Google Site Kit plugin, to understand how visitors use the site so we can improve it. Google Analytics sets cookies (typically named _ga and _ga_<id>) and may collect your IP address, device and browser information, and the pages you view. You can opt out of Google Analytics using Google’s browser add-on at tools.google.com/dlpage/gaoptout, and you can manage or block cookies through your browser settings. The website itself does not set advertising or tracking cookies of its own. WordPress may set a first-party cookie to remember your details if you leave a blog comment and choose that option. Our free utility tools run in your browser and do not transmit the values you enter to us.

6. How we share information

We do not sell your personal information. We share information only with the service providers that help us operate the Services, and only as needed for them to perform their function:

  • Hosting and content delivery (the providers that serve the website and store its data);
  • Analytics (Google, as described above);
  • Email delivery (the email service used to transmit contact-form notifications and our replies);
  • Payments and distribution (Gumroad for storefront purchases; Apple for App Store distribution and purchases).

We require these providers to protect your information and to use it only to provide services to us, consistent with this policy. We may also disclose information if required by law, to protect our rights, or in connection with a business transfer. We do not authorize any third party to use the personal information we share for its own unrelated purposes.

7. Our applications

Our software applications, including those distributed through the Apple App Store, are designed to work on your device. They do not collect personal data. The data you create in an application (for example, the entries in a calculator or generator, or the content of a document) is stored on your own device and is exported only when you choose to export it. This is reflected in each application’s App Store privacy label, which is published as “Data Not Collected”.

The applications do not require an account and do not transmit your content to DevWharf. Purchases of paid applications are handled by the Apple App Store under Apple’s own privacy terms, and Apple may collect analytics or diagnostic information in accordance with its policies and your device settings. If a future version of an application introduces a feature that collects or transmits data, we will update this policy and the relevant App Store privacy label before that feature ships.

8. International data transfers

DevWharf is based in the United States, and the website’s information is processed in the United States. If you access the Services from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States, where data-protection laws may differ from those in your jurisdiction. Where required, we rely on appropriate safeguards for such transfers.

9. Data retention and deletion

We keep contact-form submissions and related correspondence for as long as needed to respond to your inquiry and to maintain our business records, and then delete or archive them. Blog comments remain published until you or we remove them. Analytics data is retained according to the provider’s settings. You may ask us to delete the personal information we hold about you, and you may withdraw your consent at any time, by emailing support@devwharf.com; we will honor your request subject to any records we are legally required to keep. Because the applications store your data on your own device, you control that data directly and can delete it by removing it from your device or uninstalling the application.

10. Your privacy rights

Depending on where you live, you may have rights regarding your personal information. If you are in the European Economic Area or the United Kingdom, you have the right to access, correct, delete, restrict, or object to our processing of your personal information; the right to data portability; the right to withdraw consent at any time; and the right to lodge a complaint with your local data-protection supervisory authority. 11. California privacy rights

If you are a California resident, the California Consumer Privacy Act (as amended) gives you the right to know what personal information we collect and how we use and disclose it, the right to access and delete your personal information, the right to correct inaccurate information, and the right to opt out of the “sale” or “sharing” of personal information. We do not sell or share your personal information as those terms are defined under California law, and we do not use or disclose sensitive personal information for purposes that require an opt-out. We will not discriminate against you for exercising any of these rights. To make a request, email support@devwharf.com.

12. Children’s privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us at support@devwharf.com and we will delete it.

13. Data security

We use reasonable technical and organizational measures to protect personal information, including encryption in transit (HTTPS/TLS) and access controls. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

15. Changes to this policy

We may update this policy from time to time. When we do, we will revise the “Last updated” date above, and significant changes will be reflected on this page. Your continued use of the Services after a change takes effect constitutes acceptance of the updated policy.
